Miami DUI Attorneys

The National Highway Transportation Safety Administration (NHTSA) produced an instruction manual entitled the “DWI Detection and Standardized Field Sobriety Testing Instructor Manual”. The purpose of this document is to train police officers how to properly detect those who are driving while intoxicated (DWI) throughout areas in the United States including the state of Florida. The manual outlines exactly how a police officer should administer and judge suspected drunk drivers using standardized field sobriety tests. However, it is not uncommon for officers to improperly follow the standardized procedures that are outlined by the NHTSA. In some rare cases, there are officers who were never trained on how to test for a drunk driver using the guidelines created by the Nation Highway Transportation Safety Administration. If you were arrested for failing a sobriety test in the state of Florida, it is important that you contact a DWI attorney to discuss your sobriety test and your possible legal options.

Have you or someone you know been charged for drunk driving in Miami Beach due to a failed sobriety test? Contact a Miami DUI Attorneys for a free consultation.

Common sobriety tests include:

  • Balancing on one foot
  • Walking a straight line
  • Counting backwards
  • Reciting the alphabet

For those officers who do not follow the standard sobriety tests, they often use improper techniques, that in some cases, could be impossible to pass even if an individual was sober. Furthermore, the NHTSA states that failure to follow their guidelines would make the sobriety test invalid. A DWI attorney from our Florida law firm will examine whether or not a given sobriety test followed the guidelines of the NHTSA and if the arresting officer was right to conclude a person was driving while intoxicated.
