Although Florida is known for its nightlife with its nightclubs and bars in Miami and Fort Lauderdale, many may wrongly believe that Florida is lenient when it comes to its drunk driving laws. However, the truth of the matter is that Florida has harsh consequences for those who are caught on the road drunk. Depending on the circumstances, the punishment of a DUI charge can range from huge fines to several months in prison. If an individual has been charged with drunk driving in the Fort Lauderdale or Miami area, it is imperative that he or she contact a DUI lawyer from the law office of Brody, OBeidy & Marcellus to aggressively fight for their rights.

Under Florida law, a person is guilty of drunk driving and is subject to punishment if the driver meets anyone of the following conditions:

  • The driver is under the influence of any kind of alcoholic beverages or chemical substance that impairs the driver’s normal faculties.
  • The driver has a blood alcohol level (BAL) of 0.08 or more grams of alcohol per 100 milliliters of blood
  • The driver has a breath alcohol level of 0.08 or more grams of alcohol per 210 liters of breath.

Anyone who is charged with drunk driving for the first time and is found guilty will be fined an amount no less than $250 or more than $500 and can receive no more than 6 months of prison. Those who receive a second conviction for a DUI can be fined an amount no less than $500 or more than $1,000 and can receive 9 months of prison. In addition, those convicted of a DUI charge for a second time will have an ignition interlock device installed in their vehicle at the sole expense of the convicted person for a period of at least one year.

A drunk driving conviction can have other serious consequences besides prison and fines. If convicted of a DUI, the charge will stay on the convicted person’s record forever. This can make it difficult to obtain employment or other benefits later on in life. That is why it is imperative a person contact a lawyer if arrested for drunk driving. A lawyer from our law firm will do everything they can to have the charges dropped or to have the sentencing reduced.
