The penalties for those who are convicted of a DWI for a second time are much more harsh than those who are convicted for the first time. Anyone who is convicted of a second DWI in the state of Florida can receive up to 9 months of prison or 12 months if the second conviction is within 5 years of the first DWI conviction. In addition, a person can have their Florida license suspended from 180 days to 1 year. However, a minimum 5 year revocation may be applied if the second conviction is within 5 years of the first drunk driving offense.
