Under Florida law, a person is guilty of drunk driving and is subject to punishment if the driver meets anyone of the following conditions:

  • The driver is under the influence of any kind of alcoholic beverages or chemical substance that impairs the driver’s normal faculties.
  • The driver has a blood alcohol level (BAL) of 0.08 or more grams of alcohol per 100 milliliters of blood
  • The driver has a breath alcohol level of 0.08 or more grams of alcohol per 210 liters of breath.

Anyone who is charged with drunk driving for the first time and is found guilty will be fined an amount no less than $250 or more than $500 and can receive no more than 6 months of prison. Those who receive a second conviction for a DUI can be fined an amount no less than $500 or more than $1,000 and can receive 9 months of prison. In addition, those convicted of a DUI charge for a second time will have an ignition interlock device installed in their vehicle at the sole expense of the convicted person for a period of at least one year.


A drunk driving conviction can have other serious consequences besides prison and fines. If convicted of a DUI, the charge will stay on the convicted person’s record forever.
